who has the right of way in a parking lot?

I recently had an accident in a parking lot and was wondering who has the right of way. I was in the process of backing out of a spot and was far enough out that I was about to turn my wheel to the right (no one was in the spot to my left) when the other driver and I hit. I did not see her as a began backing out and she must have come into view when I turned around to turn my wheel. We did not file a police report but now I’m thinking of going to court because the other driver claims I caused $3100 worth of damage. I have a convertible and she a Sequoia. Her back passenger door is a bit dented and the fender on the back passenger is scratched but nothing more. Does anyone think this is worth fighting or should I just file it through the insurance company?

If you were both backing out, you are equally at fault. If she was traveling forward, then she had the right of way and you are at fault.

Why isn’t anyone talking to their insurance company and having them deal with the liability? If you have insurance, there’s no need for you to take this to court.
