penalty 4 selling Defective game to gamestop?

I received a defective game from gamestop so I thought it would be fair 2 get used game credit by selling it 2 them, they asked me 4 my address, phone # , last name and my sig, will the defective game be traced back 2 me and if so what is the penalty
